Can 8 year old ride on the back of a Harley Davidson in Ohio?

My ex-husband owns a Harley Davidson Motorcycle and would like our eight year old daughter to ride on the back with a helmet. We live in Ohio. Is there an age in Ohio to ride as a passenger? My concern is that this is not safe. He doesn’t wear a helmet which in my opinion doesnt set a good example….Any input greatly appreciated!!!
